Jewish Clergy Decry Trump’s Move to Strip Refugees’ Legal Status

The American Jewish community has long affirmed its commitment to standing up for the rights and dignity of those seeking safety in our country. In response to the Trump administration’s new rule that can revoke the legal status of refugees and lead to their deportation, more than 600 Jewish clergy from across the United States have signed a letter expressing their concern for the safety of refugees. Here is the full text of the letter.

The Trump Administration has announced a rule that allows the government to quickly terminate the refugee status of people resettled and living in the United States. This rule puts the very people that our government vetted and actively sought to welcome at risk of deportation. As Jewish clergy, we condemn this action as cruel to the individuals impacted, alarming in its implications for refugees globally and corrosive to our collective integrity as a society.

Like many of the policies enacted by this administration, this rule is designed to make refugees and immigrants less safe. It also, like previous policies, strips away meaningful due process. According to the new rule, refugees will only have ten days to challenge the government’s “notice of intent to terminate-NOIT” their refugee status. In practice, that short amount of time available to fight a NOIT renders it essentially meaningless. This administration has already systematically shut down pathways for people in need of safety, stripped legal status from hundreds of thousands of people and invested billions into mass detention and deportation. This rule represents another significant escalation in its attempt to dismantle humanitarian norms and laws enshrined in the aftermath of World War II.

Nothing could be more terrifying to people who have trusted the U.S. government with their lives and future than being thrust into the terrifying possibility of removal proceedings. Resettlement and asylum are meant to be durable solutions — ones that promise permanent safety. While the U.S. government has always had the authority to terminate the refugee status of individuals, that option has never before been wielded as a blunt weapon. Drawing upon our own history, it is unthinkable to imagine that Jews who fled and legally resettled here after fleeing persecution in Europe or Iran or the Former Soviet Union would start a new life only to be expelled back into harm’s way.

As we trade in our beacon of welcome for a reputation of inhumanity, all of society will bear the consequences – from the weight of our collective moral failure to the loss of talent, ingenuity, and economic contribution that has characterized every generation of refugees, immigrants and asylum seekers.

Deuteronomy 23:24 proclaims, “You must fulfill what has crossed your lips and perform what you have voluntarily vowed.” Jewish tradition considers breaking a promise to be one of the most serious of transgressions. When we collectively turn back on the promises we have made, we eviscerate our credibility with others and undermine confidence in our institutions. Volumes of rabbinic discussion are devoted to the notion that fidelity to our promises has the power to sustain or destroy society.  As the medieval commentator Rabbeinu Bahya declares “This is why the sages have stated that anyone who reneges on his promises invites [a penalty like the flood in the time of Noah].”

As we raise our voices in moral outcry, we call upon our elected officials to do the same and pressure the administration to withdraw this rule as one step back in the right direction toward humane and reasonable immigration policy.
